1. Agreement to these Terms
These Terms of Service ("Terms") form a binding agreement between you and Elite Nursing Services, LLC ("we," "us," "our," or "the practice"). They govern access to and use of our website, client portal, consultation requests, onboarding, billing interfaces, and concierge nursing services.
By accessing our website, creating an account, submitting a consultation or booking request, signing consents, or receiving services, you agree to these Terms. If you do not agree, do not use our digital services or enroll.
If you enroll or act on behalf of another adult, you represent that you have legal authority (for example, as the individual, a legal guardian, or an authorized representative) to accept these Terms and related consents for that person where permitted by law.
2. About our nursing concierge practice
Elite Nursing Services, LLC provides private-pay concierge nursing and care-coordination services, which may include in-home nursing assessments, vital-sign and wellness monitoring, medication review and education, chronic-disease support, care coordination with authorized clinicians, appointment accompaniment when arranged, hospital-to-home support when included in a plan, and communication with authorized family members or care partners.
Service geography is centered on Greater Kansas City metro area and surrounding areas (30-mile radius from Overland Park, KS). Travel or consultations outside published parameters may involve additional fees as disclosed (including consultation fees outside our standard radius when applicable).
Published business hours are Monday – Friday, 9:00am – 4:30pm. Saturday by Appointment Only. Hours may change; the practice website and portal are the current reference.
3. Not emergency, urgent, or continuous care
Our services are not a substitute for emergency medical services, an emergency department, urgent care, inpatient hospital care, or continuous bedside nursing unless a separate written agreement expressly provides otherwise.
If you or the care recipient experience a medical emergency, call 911 or go to the nearest emergency facility immediately. Do not rely on portal messages, email, or routine phone lines for life-threatening situations.
We do not guarantee immediate response, same-hour dispatch, overnight coverage, or 24-hour on-call standby as part of standard plans.
4. Plans, visits, and clinical judgment
Plan inclusions, visit cadence, and add-on rates are described on our pricing materials and in your enrollment selections. Features may be clarified in your individualized care approach and visit documentation.
Nursing services are delivered according to professional standards, clinical judgment, and information available to us. We may recommend physician follow-up, decline unsafe requests, or pause services if required information is missing or the home environment is unsafe for staff or the client.
Nursing education and coordination do not replace orders from physicians or other licensed independent practitioners. Clients remain responsible for following medical advice from their treating providers.
5. Unlimited visits (Elite and similar plans)
Where a plan includes unlimited visits, that means there is no fixed monthly visit cap for scheduled in-home nursing visits arranged through the practice. Visits are scheduled during published business hours (Monday – Friday, 9:00am – 4:30pm) and Saturday by appointment when offered, subject to nurse availability and clinical appropriateness.
Unlimited visits do not mean continuous bedside care, overnight coverage, immediate same-hour response, or 24-hour on-call or emergency standby. For emergencies, call 911 or go to the nearest emergency facility.
Routine portal messages and calls about care are handled during published business hours unless we arrange otherwise in writing.
6. Consultations and service area
Consultations carry a standard disclosed fee. Care locations outside our published service radius from Overland Park, Kansas may include an additional out-of-area fee. Fees may be collected before or after the consultation as stated in the consultation flow.
Submitting a consultation request does not create a clinical relationship until we accept the engagement and complete applicable onboarding and consents. We may decline requests outside our capacity, geography, or clinical scope.
7. Accounts, portal access, and authorized users
You must provide accurate registration information and keep it current. You are responsible for safeguarding login credentials and for activity under your account.
Portal access may be granted to the client and to family members or care partners you authorize, with permission levels you approve. You are responsible for keeping authorized users current and for requesting revocation when access should end.
You agree not to share credentials, attempt unauthorized access, probe or disrupt systems, upload malware, scrape the site, or use the portal to harass staff or other users.
We may suspend or terminate access for security risk, misuse, nonpayment (subject to continuity rules), or material breach of these Terms.
8. Communications
Portal messaging and routine phone/email contact are for non-urgent matters during business hours unless we arrange otherwise. Messages are not continuously monitored for emergencies.
You authorize us to contact you (and approved contacts) about scheduling, visit reminders, care updates, billing, onboarding, and security notices using the channels you provide, subject to your communication consents and applicable law.
Unencrypted email and SMS carry inherent privacy risks; use the portal for sensitive clinical detail when practical.
9. Client confidentiality and privacy
We maintain client confidentiality as a professional and legal obligation. Details of your care are not disclosed to unauthorized persons.
Our Privacy Policy and HIPAA Notice of Privacy Practices describe how personal and protected health information is handled, including need-to-know access, minimum necessary standards for certain disclosures, and your rights.
You agree not to post identifiable information about other clients, and not to record or publish staff or visit interactions without appropriate consent and lawful basis.
If you grant family portal access, you understand those users may see information consistent with their permission level. Choose access carefully.
10. Documentation and records
We create and maintain clinical and administrative documentation related to visits, coordination, and billing. Records are retained according to applicable law and professional standards.
You agree to provide accurate health history, medications, allergies, and living-situation information needed for safe care, and to update us when material changes occur.
11. Fees, billing, and cancellation
Fees for packages, add-ons, consultations (including out-of-area surcharges when applicable), travel, missed visits, and late cancellations are disclosed before purchase or as published by the practice. Recurring plans renew according to checkout terms until cancelled per those terms or written notice accepted by the practice.
Payment processing is handled by our payment provider. Clinical narratives are not sent to card processors; only billing identity and plan/invoice references needed to collect payment are shared.
Failed payments may result in pause of new scheduling until the account is current, except where continuity requirements or written arrangements apply.
Refund eligibility, if any, follows plan terms disclosed at purchase and applicable law. Unused portions of a billing period may not be refundable after services have begun.
12. Scheduling, cancellations, and access to the home
Visits occur by appointment. Please provide reasonable notice for cancellations or rescheduling. Late cancellations or no-shows may incur fees as disclosed.
You agree to provide safe, lawful access to the service location, disclose known hazards relevant to staff safety, and ensure animals or other conditions that could endanger staff are controlled during visits.
We may leave or decline to complete a visit if the environment is unsafe, if required decision-makers are unavailable for consent-sensitive care, or if requested services fall outside our scope.
13. Intellectual property
Website content, branding, logos, document templates, and software interfaces are owned by the practice or its licensors and are protected by intellectual-property laws. You may not copy, modify, or commercially exploit them without prior written permission, except for personal use of materials we provide for your care.
14. Disclaimers
Website and portal content is provided for general information and care coordination support and is not a guarantee of outcomes. Services are provided "as available." To the maximum extent permitted by law, we disclaim warranties not expressly stated in writing, including implied warranties of merchantability or fitness for a particular purpose, as they relate to digital services.
Nothing in these Terms reduces professional duties owed in the delivery of licensed nursing care under applicable practice acts and standards of care.
15. Limitation of liability
To the fullest extent permitted by law, the practice and its owners, nurses, and contractors are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, or goodwill, arising from use of the website or portal.
Our aggregate liability arising from digital-service use under these Terms is limited to the greater of fees you paid to us for the digital service giving rise to the claim in the twelve months before the claim or one hundred U.S. dollars, except where liability cannot be limited under law.
Clinical malpractice or professional-liability claims, if any, are governed by applicable professional liability law and are not expanded or created by these website Terms. Nothing in these Terms limits rights you cannot waive under applicable law.
16. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless the practice from claims arising out of your misuse of the portal, your provision of false information, unauthorized sharing of credentials, or your violation of these Terms, except to the extent caused by our willful misconduct or as prohibited by law.
17. Suspension and termination
You may stop using the website at any time. Portal enrollment and care services may be ended according to plan cancellation terms, mutual written agreement, or for cause including safety concerns, material breach, fraud, abusive conduct, or inability to meet clinical needs safely.
Provisions that by nature should survive (including confidentiality, accrued payment obligations, disclaimers, liability limits, and governing law) survive termination.
18. Changes to the Terms
These Terms are version 2026-08-10. We may update them periodically. Material changes will be posted on the website and/or portal. Continued use after the effective date constitutes acceptance where permitted. If you do not agree, discontinue use and contact us regarding active care arrangements.
19. Governing law and disputes
These Terms are governed by the laws applicable to the practice's primary operations, without regard to conflict-of-law rules that would require another jurisdiction's law, except where federal law (including HIPAA) controls.
Before filing a formal dispute related to digital services, you agree to contact us in good faith to seek resolution. Nothing here limits rights to report privacy concerns to regulators or to seek emergency relief.
20. General provisions
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization or transfer of the practice. These Terms, together with the Privacy Policy, HIPAA Notice, and signed consents/plan terms, are the complete agreement regarding the subjects covered, superseding prior informal discussions on those subjects.
