How we collect, use, share, and protect personal and health information for our private-pay nursing concierge practice, website, and client portal — including client confidentiality.

1. Introduction and scope

Elite Nursing Services, LLC ("we," "us," "our," or "the practice") operates a private-pay concierge nursing practice. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information and health-related information in connection with our website, client portal, consultations, onboarding, nursing visits, care coordination, messaging, billing, and related administrative activities.

This Policy applies to clients, prospective clients, authorized family members and care partners, website visitors, and other individuals who interact with our digital or clinical services. It works together with our HIPAA Notice of Privacy Practices (which addresses protected health information used for treatment, payment, and health-care operations) and our Terms of Service.

By using our website or portal, submitting a consultation request, creating an account, or receiving services, you acknowledge this Privacy Policy. If you do not agree, do not use our digital services or provide information beyond what is required for emergency situations.

2. Our role as a nursing concierge practice

We provide private nursing assessments, in-home visits, medication review and education, chronic-disease support, care coordination with authorized clinicians, appointment accompaniment when arranged, and related concierge services described in your plan. We are not a hospital, emergency department, home health agency governed solely by Medicare home-health rules, or a 24-hour on-call emergency service unless expressly agreed in writing.

Because nursing concierge care is relationship-based and often delivered in the home, we take heightened care with client confidentiality, household privacy, and the sensitivity of clinical details shared by clients and families.

3. Categories of information we collect

Identity and contact data: name, date of birth when provided, postal address, email, phone numbers, relationship to the care recipient, and emergency contacts.

Account and security data: login identifiers, authentication factors, password hashes managed by our identity provider, session metadata, and security event logs.

Clinical and care data: health history, diagnoses, medications, allergies, functional status, visit notes, care plans, assessments, and documents you upload or authorize us to receive.

Household and logistics data: service location, access instructions you provide, scheduling preferences, and travel or service-area details needed to deliver visits safely.

Billing and commercial data: plan selection, invoice and payment references, payer name and email, consultation fee status, and related ledger entries. Full payment card numbers are processed by our payment provider and are not stored in our clinical systems.

Communications content: portal messages, consultation forms, emails or calls you initiate with the practice, and records of authorized family updates.

Technical and usage data: IP address, device/browser type, approximate location derived from network data when available, cookies or similar technologies used for security and site function, and diagnostic logs.

Professional and third-party data: information from physicians, pharmacies, facilities, or caregivers you authorize us to contact, and information required for licensing, insurance, or legal compliance.

4. Sources of information

We collect information directly from you or your authorized representative; from portal and website interactions; from clinicians and facilities you authorize; from payment and hosting vendors acting as service providers; and, where permitted, from publicly available professional sources needed for credentialing or fraud prevention.

5. How we use information

To evaluate consultation requests, determine service-area eligibility, schedule and deliver nursing visits, and maintain an accurate clinical record.

To coordinate care with physicians, specialists, pharmacies, and other providers you authorize, and to share appropriate updates with family members or care partners according to the access level you approve.

To operate the client portal, authenticate users, prevent unauthorized access, and investigate security incidents.

To process enrollment, subscriptions, invoices, consultation fees, and related billing without transmitting clinical narratives to card processors.

To meet professional nursing standards, licensing, quality improvement, training, auditing, and legal or regulatory obligations.

To communicate about scheduling, visit reminders, care updates, billing, onboarding status, and security alerts during published business hours unless otherwise arranged.

We do not use client health information for unrelated third-party marketing.

6. Client confidentiality (core commitment)

Client confidentiality is a foundational duty of this practice. Nurses and staff are expected to protect the privacy of clients and households in documentation, conversation, travel, and digital systems.

We limit access to client information to workforce members and contractors who need it to perform assigned duties (need-to-know). Role-based access controls are used in our portal and administrative systems where available.

We do not discuss identifiable client matters in public settings, social media, marketing materials, or with unauthorized third parties.

Visit documentation and messages should contain only information necessary for safe, high-quality care and coordination. Workforce members must not copy, photograph, or export client records for personal use.

When care occurs in the home, we respect household privacy to the extent consistent with safe clinical practice, including discretion around other household members who are not authorized contacts.

Breach or suspected breach of confidentiality must be reported internally without delay so we can investigate, mitigate harm, and provide any notices required by law.

7. Disclosures and sharing

We do not sell personal information or protected health information.

We may share information with: (a) authorized family members and care partners based on portal permissions or written authorization; (b) clinicians, facilities, and pharmacies involved in your care when you authorize coordination or when permitted for treatment; (c) assigned nurses, administrators, and covering clinicians within the practice; (d) vendors that provide hosting, security, communications, analytics limited to operations, or payment processing under confidentiality and data-protection obligations; (e) professional advisers (legal, accounting, compliance) under privilege or confidentiality; and (f) authorities when required by law, court order, or to avert a serious and imminent threat to health or safety.

Minimum necessary standards apply to non-treatment disclosures of protected health information to the extent required by HIPAA and our policies.

8. International and cross-border processing

Our systems and vendors may process data in the United States. If you access services from another country, your information may be transferred to and stored in the United States, where privacy laws may differ from those in your jurisdiction.

9. Retention

We retain clinical and administrative records for as long as required by applicable nursing, medical-record, tax, and privacy laws, and for as long as reasonably necessary for care continuity, dispute resolution, and audit. When records are no longer needed, we dispose of them in a secure manner designed to prevent unauthorized reconstruction.

10. Security measures

We implement administrative, technical, and physical safeguards appropriate to a nursing concierge practice, which may include encrypted transport, access controls, authentication requirements, workforce training, vendor diligence, and monitoring for suspicious activity.

No method of transmission or storage is completely secure. You are responsible for safeguarding portal credentials, using strong unique passwords, enabling available multi-factor authentication, and notifying us promptly of suspected unauthorized access.

11. Cookies and similar technologies

Our website and portal may use cookies or similar technologies that are necessary for authentication, security, load balancing, and basic site function. We do not use client clinical data to power third-party advertising networks.

You may control cookies through browser settings; disabling certain cookies may limit portal functionality.

12. Your privacy choices and rights

Subject to applicable law and clinical record rules, you may request access to or correction of account information; ask questions about our privacy practices; update authorized contacts; and adjust certain communication preferences.

HIPAA rights regarding protected health information (access, amendment, accounting of disclosures, restrictions, confidential communications, and complaints) are described in our HIPAA Notice of Privacy Practices.

Some requests may be limited where disclosure would endanger safety, violate another person's privacy, or conflict with legal retention duties.

13. Children's privacy

Our concierge nursing services and portal are directed to adults and to care arranged by adults on behalf of care recipients. We do not knowingly create marketing profiles for children. If a minor is a care recipient, information is collected from an authorized adult for care purposes under applicable law.

14. Third-party sites

Our website may link to third-party sites (for example, maps or payment pages). We are not responsible for the privacy practices of those sites. Review their policies before providing information.

15. Changes to this Policy

This Privacy Policy is version 2026-08-10. We may update it to reflect changes in services, technology, or law. Material changes will be posted on our website and/or in the client portal, and may be presented again during onboarding renewals. Continued use of our digital services after the effective date of an update constitutes acceptance of the revised Policy where permitted by law.

If you believe your privacy rights have been violated, you may also have the right to complain to the U.S. Department of Health and Human Services regarding HIPAA matters.
